Explain how 14th amendment could counteract a states decision to outlaw same-sex marriage.

The fourteenth amendment was made after the Civil War and contains the due process clause, which entitles everyone to equal rights and protection under the laws which states cannot deprive them of under their jurisdictions. So, it could be used to defend a person's rights to be married to someone of his or her same gender because the state arguably has no power to deny those people the ability to wed that other citizens that are heterosexual have.
